Terms & Conditions

1 Overview

1.1 The following terms ("Terms") apply to any use by the customer ("Customer") of the Sussex Exchange ("Venue"), and should be read carefully before being accepted by the Customer when purchasing a events ticket either online via our website events.thesussexexchange.co.uk ("Website"), by phone or in person.

1.2 By using this service the Customer accepts and agrees to be legally bound by these Terms and acknowledges that Sussex Exchange Limited ("SEL"), as the owner and operator of the Sussex Exchange. As the owner and operator of the events, SEL has the right to amend or change these Terms at any time; at its sole discretion. Any changes made will take effect immediately; the date of said changes will be clearly marked within these Terms.

1.3 In certain circumstances SEL may offer additional promotions and/or services that coincide with the events, for example seasonal events, and promotions. If so, you will be prompted to view such additional terms and conditions on our Website at the time of such purchase(s) and those terms and conditions will apply in addition to these Terms.

1.4 All materials on the Website and all intellectual property rights are owned and/or controlled by SEL and its licensors. All material on the Website is protected by copyright. Permission is granted only to electronically copy and/or print in hard copy portions of the Website for personal non-commercial purposes. Any other use of the materials on the Website (including but not limited to making such material available on any other website, online service, bulletin board or networked computer environment) is strictly prohibited without permission from SEL and its licensors.

1.5 For the purpose of this agreement the ("Customer") refers to the the ticket holder or individual who made the original event booking along with any additional attendees included in said ticket.


2 Purchasing of Tickets

2.1 You can purchase tickets for events in advance via our Website, by phone or in person at the Venue.

2.2 By ordering tickets via any of the above methods, you will only be able to book attendees that coincide with the availability of the particular event. This availability will be clearly given either via on-screen information or verbally by a member of staff.

2.3 All events bookings must be paid for in advance; bookings will only be confirmed once payment has been made either on-line, by phone, or in person. All tickets are sold on a first come, first serve basis.

2.4 When placing your order either online or in person your tickets will only be reserved for a maximum of 15 minutes from the time you start the booking process. After this time if payment has not been made these reserved tickets will be available to other Customers to purchase.

2.5 Ticket prices relate to the event you have selected, the price quoted may also change depending on the event chose, the total price of any purchase will be clearly shown on our Website or stated verbally prior to making payment. All prices and fees include value added tax ("VAT").

2.6 We are under no obligation to refund you or exchange ticket(s) in the event that you make any error when purchasing your tickets either on-line, by phone or in person (including but not limited to selecting the wrong event or the wrong number of tickets). Any changes and/or refunds in relation to a booking will be at the full discretion of SEL.

2.7 SEL reserves the right to reject a events booking for any reason at any time, in this event SEL's liability will be limited to a full refund of the fees paid to the Customer.

2.8 When purchasing tickets for an event you will not be given physical/printed tickets. You will be given a booking reference number, you will also receive an e-ticket via email and your booking reference number will also be confirmed via text message ("SMS”), if you have provided a valid mobile phone number at the time of booking. When attending your performance you will be required to either quote your booking reference, name or show your e-ticket to a member of staff.


3 Event Times

3.1 Tickets are subject to availability, the dates, times and maximum attendees available for a particular event will be clearly stated either on our Website or verbally by our staff. SEL will endeavour to ensure that advertised event schedules are met.

3.2 Event times advertised are in accordance with licencing requirements, SEL cannot take responsiblity if circumstances beyond our control directly affect the event times advertised, this can include but not limited to: changes in licencing regulations, adverse weather conditions, health & safety concerns & technical issues.


4 Age Restrictions & Licencing

4.1 Due to licensing restrictions our hosted events are for indivduals 18 years and over, due to this only individuals of and over this age will be permitted into the event(s).

4.2 We reserve the right to ask for proof of age with appropriate photographic ID went attending any event or when purchasing alcoholic beverages. If you are unable to provide this upon request you will may be asked to leave the event/venue. We reserve the right to ask for such proof at any time you are on our premises.

5 Admissions Policy

5.1 Customers must not engage in any act or speak to, any staff, or other Customers in a manner which may offend, insult, intimidate or threaten any person on any basis whatsoever including but not limited to race, religion, colour, ethnic origin, gender or that person's physical attributes. Any of the above may result is expulsion from the premises without refund.

5.2 Professional sound and video recording equipment is not permitted while an event is in progress, unless agreed with SEL prior to the event. Personal mobile phones & cameras are still permitted during events, unless otherwise stated.

5.3 Alcoholic beverages brought from outside of the premises may not be consumed on the premises, due to strict licensing laws.

5.4 No animals are permitted on the premises, except guide dogs and other assistance dogs for those with disabilities.

5.5 Smoking is not permitted within the premises in accordance with law, any individual caught smoking, including electronic cigarettes or any other artificial cigarettes or smoking devices within the building will be ejected immediately without any entitlement to a refund. (Please note that we have designated outside smoking areas at the front and rear of the property).

5.6 Customers must keep personal belongings with them at all times. We cannot accept responsibility for the loss, theft or damage to any personal items brought into the premises.

5.7 CCTV monitoring takes place within our premises for the purposes of protecting our staff, property and the safety of other Customers.

5.8 In the event that a Customer(s) breaches our Admissions Policy, SEL reserves the right to take all appropriate action to avoid a reoccurrence (including but not limited to banning such Customer(s) from the premises, we may also contact the police and take any necessary legal action if required.


6 Damage Policy

6.1 If in the event that damage is caused to either the Venue or property of SEL by any individual, the Customer who made the original event booking which included the ticket for the attendee in question will be held fully responsible.

6.2 SEL shall be entitled to charge the Customer all costs/expenses in respect of damage, loss, exceptional cleaning and the like occasioned to the Venue or any equipment by the Customer or their attendees.


7 Refunds & Cancellations

7.1 Changes to bookings or refunds will only be accepted if the event in question is more than 48 hours in advance of the request date. Any changes or refund requests made after this time will not be accepted due to the impact on our events schedule.

7.2 We will be happy to refund any booking made within 14 days of the payment date, as long as the booked event date is not within the timeframe outlined in section 7.1.

7.3 All refunds/cancellations requested for debit/credit card transactions will take approx 3-4 working days to process in line with the Visa/MasterCard refund rules and our merchant provider's policies. Cash refunds are not affected by this time frame.


8 Liability

8.1 SEL will endeavour to inform customers if there are any issues with any event prior to the day of the event in question. However SEL cannot be held liable for issues due to circumstances outside of our control. This can include but is not limited to:

• Technical failures/Power cuts
• Events outside of our control
• Weather conditions

8.2 In the event that any of the above affect any event(s) SEL will endeavour to provide alternative viewing times and/or refunds, however this is at the discretion of SEL.

8.3 SEL cannot take any responsibility if you are unable to attend your booked event for any of the following reasons:

• You have failed to attend the event at the time advertised.
• You are not of a legal age to enter the premises.


9 Data Protection & Privacy

9.1 All Customer information including but not limited to personal information, contact details and correspondence is kept confidential in our secure database. We will never reveal or sell your information to third parties.

9.2 We may use your contact information in the event that we need to contact you regarding your events booking.

9.3 When placing a booking via our website you will automatically be added to our mailing list, from which we may occasionally send you information in relation to The Sussex Exchange events. This information may include upcoming performances or seasonal events held at The Sussex Exchange, you are able to un-subscribe from our mailing list at any time.

9.4 The Internet offers a world of opportunity for children. Your guidance is essential to help ensure that children have a safe online experience. Children (persons under the age of 18) are advised to only use our Website under the supervision of a parent or guardian due to some age-restricted ratings for the events advertised.
